Summary The Commonwealth's Torres Strait Fisheries Act 1984 regulates all fishing within the Australian jurisdiction of the Torres Strait Protected Zone established by the Torres Strait Treaty between Australia and Papua New Guinea. The National Competition Policy agreements endorsed by the Council of Australian Governments in April 1995 require the Commonwealth Government to review the Torres Strait Fisheries Act 1984. The Competition Principles Agreement (CPA) specifies that Governments are to review legislation which restricts competition and, where appropriate, reform this legislation by the year 2000. Legislation should not restrict competition unless the Committee of Officials can demonstrate: 1. that the benefits to the community as a whole outweigh the costs; and 2. that the Government can only attain the objectives of the Act by legislation that restricts competition
