"Part X of the Trade Practices Act 1974 (TPA) gives ocean carriers immunity from key parts of Australia's restrictive trade practices legislation, allowing them to form conference agreements to provide joint liner (regular scheduled) cargo shipping services to Australian shippers (exporters and importers)...The inclusion of Part X in the TPA reflects a view that normal market forces and the general regulation of them under the TPA are inadequate for the efficient supply of liner cargo shipping services. Specifically, it reflects the view that collusive arrangements between ocean carriers are necessary to prevent market instability ('destructive competition') and that, unlike other industries, consideration of the arrangements would not be handled appropriately under the Part VII provisions. Testing these views is an important part of the Commission's assessment. In brief, the Commission's task in reviewing Part X is to consider: whether such industry-specific regulation is justified; that is, whether Part X should be retained; alternatives to Part X if it were to be abolished; and, if Part X were to be retained, could changes be made to improve its effectiveness." -- from the Overview, p. xxiii |
