Final rule with jurisdictional determination; August 28, 1996 Summary "On Aug. 11, 1995, FDA issued proposed regulations to reduce the number of children and adolescents who become addicted to cigarettes and smokeless tobacco. The agency proposed measures under the authority of the Federal Food, Drug, and Cosmetic Act to restrict young people's access to cigarettes and smokeless tobacco and to reduce tobacco advertising that appeals to young people. The proposed rule was accompanied by an analysis of FDA's jurisdiction over cigarettes and smokeless tobacco. FDA received over 700,000 public comments on the proposed rule and Jurisdictional Analysis. One year later, after carefully considering the public comments, FDA issued a final rule that adopted the provisions of the proposed rule with some modifications. In a Jurisdictional Determination annexed to the final rule, FDA concluded that the nicotine in cigarettes and smokeless tobacco is a drug, and that cigarettes and smokeless tobacco are drug delivery devices within the agency's jurisdiction"--Vol. one Preface, page [iii] Notes "August 1996."
