Description 1 online resource (xii, 274 pages)
Contents Bioprospecting for drug research : an overview -- Drug R & D and the structure of the industry -- International policy dimensions of bioprospecting -- Transaction costs and their impact on the market for bioprospecting -- Intellectual property rights on traditional medicinal knowledge : a process oriented perspective -- The scope of the right to regulate access
Summary Annotation Bioprospecting-the search for useful biochemical compounds and genes in nature-has been the focus of international negotiations for more than a decade. The debate on the terms for access to genetic resources, traditional knowledge, and benefit-sharing is far from settled. This book examines the optimal property rights structures and institutional mechanisms for regulating bioprospecting for drug research. It includes examples of bioprospecting collaborations in several countries. Regulating Bioprospecting is one of the first books to address the contractual complexities of bioprospecting for drug research and is thus a key text for policymakers, practitioners, and scholars in the areas of law, economics, ethnobotany, anthropology, and environmental sciences
Annotation Biodiversity prospecting, or the search for useful bioactive compounds and genes in nature, has been the focus of international negotiations for more than a decade, yet the debate on the terms for access to genetic resources and traditional knowledge in the bioprospecting process is far from settled. This book employs an interdisciplinary law and economics methodology to derive structures for optimal property rights and institutional mechanisms for regulating bioprospecting for drug research. Focusing on the economics of contracts in the drug discovery and development process using genetic resources, it shows that the rights exchanged at each stage of the process are complementary to one another. This book is one of the first to address the contractual complexities of bioprospecting for drug research and is thus a key text for policy makers and practitioners, university scholars and students in the areas of law, economics, ethnobotany, anthropology and environmental sciences
